Welcome, and thanks for playing. These terms govern your use of Scrambly ("the app"), a casual word game published by Peter Li, operating under the name Apptato, based in Ontario, Canada. By downloading, installing, or using the app, you agree to these terms. If you don't agree with them, please don't use the app.
Scrambly is a free anagram word game for iPhone and iPad. It's a simple game: find all the words that can be formed from a set of scrambled letters within a time limit. The app is free to download and play, and is supported by occasional advertisements between rounds.
I grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use Scrambly on any iOS device you own or control, for your personal non-commercial enjoyment. This license is limited — you may not copy, modify, distribute, sell, rent, lease, or reverse-engineer the app. You may not remove copyright or other proprietary notices. You may not use the app in a way that violates any applicable law.
Scrambly is a single-player game with no chat, messaging, or user-generated content, so there's not a lot you could do wrong here. Still, by using the app you agree not to:
Cheating on the Game Center leaderboard may result in your scores being removed by Apple or by me, at my sole discretion.
Scrambly displays interstitial advertisements between gameplay rounds. Ads are served by Google AdMob. I do not individually review or endorse the specific ads you see — they are selected and delivered by Google's advertising system. If you see an ad you believe is inappropriate or misleading, please report it through Google's ad feedback mechanism or contact me at the address below.
Scrambly integrates with Apple's Game Center to display a public leaderboard of high scores. Your participation in the leaderboard is optional and controlled through your device's Game Center settings. Apple is responsible for the operation of Game Center, and your use of it is subject to Apple's own terms and privacy policy.
The Scrambly app, including its code, graphics, sound effects, and design, is owned by Peter Li (Apptato) and is protected by copyright and other intellectual property laws. The anagram word list used within the app is sourced from public educational materials at enchantedlearning.com and is used for educational/gameplay reference.
Scrambly does not offer in-app purchases, subscriptions, or any paid features at this time. The app is free, and there is nothing to buy within it. Any future version of the app that introduces in-app purchases will do so under updated terms clearly presented to you at that time.
Your use of the app is also governed by the Scrambly Privacy Policy, which describes what information (if any) is collected and how it's handled. Please review it.
Scrambly is provided "as is" and "as available," without warranties of any kind, whether express or implied. While I try to keep the app stable, fun, and bug-free, I can't guarantee that it will always work perfectly, be free of errors, be available without interruption, or be compatible with every device and iOS version. You use the app at your own discretion.
To the fullest extent permitted by applicable law, I disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, Peter Li (Apptato) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app — including loss of data, loss of enjoyment, or any other intangible loss. My total liability to you for any direct damages arising from your use of the app shall not exceed the amount you paid to use it, which for a free app is zero dollars ($0).
Nothing in these terms limits any rights you may have under applicable consumer protection law that cannot be waived by agreement.
You can stop using the app at any time by deleting it from your device. I reserve the right to discontinue the app, remove it from the App Store, or modify it at any time, for any reason, without notice. If the app is discontinued, your local data (game stats, settings) will remain on your device unless you delete the app.
I may update these terms occasionally. When I do, I'll update the effective date at the top of this page. Material changes will be noted in the app's release notes on the App Store. Your continued use of the app after changes take effect constitutes acceptance of the updated terms.
These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. You agree that any legal dispute arising from these terms or your use of the app will be handled in the courts of Ontario, Canada, unless applicable consumer protection law in your jurisdiction gives you additional rights.
Scrambly is distributed through Apple's App Store. You acknowledge that these terms are between you and me (Peter Li / Apptato), not Apple. Apple is not responsible for the app, its content, or any claims related to it. Apple is, however, a third-party beneficiary of these terms and may enforce them against you.
If any provision of these terms is found to be unenforceable, the rest of the terms will remain in full effect.
